These Terms and Conditions ("Terms") govern your use of PreInspect.com.au ("we", "our", "us", "the Platform"). By accessing or using our services, you agree to comply with and be legally bound by these Terms. If you do not agree, you must refrain from using the Platform.
1. Purpose of Service
PreInspect.com.au is a SaaS platform that uses artificial intelligence to analyse user-uploaded property images and videos for potential building or pest-related issues. The results generated are for informational purposes only and are not a substitute for professional, licensed building or pest inspections.
2. Eligibility and Age Restrictions
You must be 18 years or older to use this Platform. By registering or using PreInspect.com.au, you warrant that you are at least 18 years old and legally able to enter into a binding contract. Accounts found to be in breach of this requirement may be suspended or terminated without notice.
3. User Responsibilities
You agree that:
- You are solely responsible for the content you upload
- You have the necessary rights to upload and use such content
- You will not use the Platform for unlawful, abusive, misleading, or harmful purposes
- You will independently verify any AI-flagged risks with a licensed professional
- You understand the results are indicative and not certified assessments
4. Limitations of AI Analysis
The Platform's AI engine analyses visible elements in user-submitted photos and videos. It cannot detect hidden issues, non-visible pests, or internal damage not present in the uploaded media. No guarantee is made regarding the completeness or accuracy of any analysis. Use of the service is at your own risk and discretion.
5. Credit-Based System
5.1 Purchases and Usage
All services on PreInspect.com.au operate via a prepaid credit system. Once purchased, credits are immediately available for use.
5.2 No Monetary Refunds
We do not provide monetary refunds for any reason, including but not limited to:
- Change of mind
- Incorrect credit package selection
- Misunderstanding of features
- User error during upload
Due to the digital nature of our services and instant access to credits, all sales are final.
5.3 Credit Refunds for Failed Services
We may provide a credit refund (not cash) if:
- A confirmed technical fault on our end prevents the AI from completing analysis
- A refund request is submitted within 7 calendar days of the issue
- You provide sufficient evidence (account email, upload time, and screenshot or error message)
We reserve the right to deny credit refunds for issues caused by low-quality or incompatible media files.
6. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. If a major failure occurs and a credit refund is not sufficient, we may escalate your issue in accordance with your statutory rights.
7. Data Storage, Retention, and Security
Uploaded media may be stored on secure Australian or international servers for the purposes of:
- Processing and analysis
- Troubleshooting and system improvement
- Quality assurance
We apply industry-standard security practices; however, no system is 100% immune to data breaches. You acknowledge and accept the inherent risks of digital data use and storage.
8. Content Ownership and Licensing
You retain ownership of the media you upload. By submitting content, you grant us a non-exclusive, royalty-free, worldwide licence to:
- Store, process, and analyse your media
- Use the media for service delivery, internal system training, customer support, and performance auditing
We will not sell or redistribute your media without consent.
9. Service Availability and Disclaimer
We strive for high availability but do not guarantee uninterrupted access. The Platform may experience scheduled maintenance, technical faults, or system outages.
We are not liable for:
- Loss of access
- Delays or interruptions
- Inaccurate or incomplete analysis
- Indirect or consequential losses related to system performance
10. Usage Limits and Fair Use
Use of the Platform is subject to fair use. We may restrict, suspend, or terminate accounts exhibiting:
- Excessive or abusive usage
- Automated or scripted access
- Attempts to scrape, replicate, or resell our services without authorisation
We reserve the right to enforce usage caps or throttle access at our discretion.
11. User Conduct and Prohibited Activities
You agree not to:
- Upload files containing offensive, illegal, or violent content
- Use the Platform to violate any laws or rights
- Attempt to reverse engineer or interfere with the Platform
- Upload malicious files or code
- Sell or redistribute analysis results without written approval
Violations may result in immediate account suspension, reporting to authorities, and legal action.
12. Privacy Policy
Our handling of your personal information is outlined in our separate Privacy Policy. By using our services, you consent to the collection, use, and storage of your data as described therein.
13. Modifications to These Terms
We may update these Terms periodically. Changes will be posted on the website with a revised "Effective Date." Continued use of the Platform after updates constitutes acceptance of the new Terms.
